Welcome to Charlotte King Art. These Terms & Conditions apply to your use of this website and to purchases made through charlottekingart.com.au.

By using this website or placing an order, you agree to these Terms & Conditions.

1. About Charlotte King Art

Charlotte King Art is an Australian art business based in Sydney, NSW, offering original artworks, limited-edition fine art prints and commissioned artworks.

Throughout these Terms & Conditions, “Charlotte King Art”, “we”, “us” and “our” refer to Charlotte King Art.

2. Products

We take care to represent our artworks and prints as accurately as possible through photographs, descriptions and dimensions.

Please note that colours may appear slightly different depending on your screen, device and display settings. Original artworks are handmade and may include variations in texture, surface and finish that are part of the nature of the work.

Fine art prints are professionally produced from high-quality, colour-matched reproduction files. While every effort is made to faithfully reproduce the original artwork, there may be subtle differences between a print and the original painting.

3. Original Artworks

Each original artwork is a unique, one-of-a-kind piece.

Once an original artwork has been sold, it will no longer be available for purchase. In the unlikely event that two orders are placed for the same original artwork before the website has updated its availability, the first successfully completed order will take priority and any subsequent payment will be refunded in full.

4. Limited-Edition Prints

Limited-edition prints are produced in strictly limited quantities, with the edition size stated on the individual artwork or product page.

Each limited-edition print is supplied with a Certificate of Authenticity identifying its edition number.

Once an edition has sold out, no additional prints will be produced in that same edition, size and format.

5. Pricing and Payment

All prices are displayed in Australian dollars (AUD) unless otherwise stated.

Payment must be made in full at the time of purchase using one of the payment methods available at checkout.

Charlotte King Art reserves the right to change product prices at any time. Any price change will not affect an order that has already been confirmed and paid for.

Any applicable taxes will be handled in accordance with Australian taxation requirements.

6. Shipping

Shipping is free Australia-wide unless otherwise stated on the website or at checkout.

Original artworks and prints are carefully packaged to protect them during transit. Prints are made to order, so please allow time for production as well as delivery.

Estimated production and delivery times provided on the website are a guide only. While we will make every reasonable effort to meet these timeframes, delays may occasionally occur that are outside our control.

Customers are responsible for providing a complete and accurate delivery address. Please contact us as soon as possible if you notice an error in your delivery details.

7. Damaged or Faulty Items

We take great care in producing, packaging and dispatching artwork.

If your artwork arrives damaged, faulty or incorrect, please contact us as soon as reasonably possible after delivery at hello@charlottekingart.com.au and include your order number and photographs showing the issue and packaging where relevant.

We will work with you to resolve the issue in accordance with your rights under the Australian Consumer Law.

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law that cannot lawfully be excluded.

8. Change-of-Mind Returns

We want you to love your artwork and feel confident in your purchase.

Original Artworks

If you change your mind about an original artwork, you may return it within 14 days of delivery, provided it is in its original, pristine condition, undamaged and securely packaged for return.

Customers are responsible for return shipping costs, and we recommend using a tracked and insured delivery service. Once the artwork has been received and inspected, a refund will be issued to the original payment method, provided the return conditions have been met.

Fine Art Prints

Fine art prints are individually made to order. For this reason, we do not accept change-of-mind returns or exchanges on prints.

Your Consumer Rights

This policy does not affect your rights under the Australian Consumer Law. If an artwork or print is faulty, damaged, incorrectly supplied or otherwise fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement or refund in accordance with Australian law.

9. Commissions

Charlotte King Art accepts a limited number of commissions.

Commission details, including the subject, dimensions, price, deposit, expected timeframe and any other specific requirements, will be agreed with you before work begins.

Because commissioned artworks are created specifically for an individual customer, deposits and payments may be subject to separate terms provided and agreed to before the commission begins.

10. Cancellation of Orders

If you would like to cancel or change an order, please contact us as soon as possible.

Where a made-to-order print has already entered production, we may not be able to cancel or change the order for change-of-mind reasons.

If we are unable to fulfil an order for any reason, we will contact you and provide an appropriate refund.

11. Copyright and Intellectual Property

Unless otherwise stated, all artwork, images, photographs, text, branding and other content appearing on this website are owned by or licensed to Charlotte King Art and are protected by applicable copyright and intellectual property laws.

Purchasing an original artwork or fine art print gives you ownership of the physical artwork or print only. Copyright and reproduction rights remain with Charlotte King Art or the relevant copyright owner unless expressly agreed otherwise in writing.

Artwork and images may not be copied, reproduced, modified, distributed, used commercially, used to create derivative works or used to produce prints or other products without prior written permission from the relevant rights holder, except as permitted by law.

12. Website Use

You may browse and use this website for personal, non-commercial purposes.

You must not misuse the website, attempt to interfere with its operation, use its content without permission or engage in activity that infringes the rights of Charlotte King Art or another person.

We may update, modify or remove website content from time to time without notice.

13. Third-Party Services

Our website may use third-party services to provide functions such as website hosting, payments, email communications, printing, fulfilment and delivery.

Your use of some of these services may also be subject to the relevant third party's terms and privacy practices.

14. Liability

To the maximum extent permitted by law, Charlotte King Art excludes liability for indirect or consequential loss arising from your use of this website or the purchase or use of our products, except to the extent that such liability cannot lawfully be excluded.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot legally be excluded under the Australian Consumer Law.

16. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our business, website or legal obligations.

The version published on this website at the time you place an order will apply to that purchase.

These Terms & Conditions are governed by the laws of New South Wales, Australia and applicable Commonwealth laws.
